TERMS AND CONDITIONS

1. GENERAL PROVISIONS

1.1 These terms and conditions (hereinafter - Terms) apply to any Buyer placing an order and purchasing goods from AISTĖ SOTVARAITĖ, individual activity certificate No. 1081805, registered at Titnago g. 7-217, Vilnius (hereinafter - Seller), on the online store www.aistesot.com (hereinafter - Online Store).

1.2 By placing an order and purchasing goods from the Online Store, the Buyer confirms that they have read and unconditionally agree to these Terms and the Privacy Policy. The Buyer may not place an order without agreeing to the Terms and the Privacy Policy.

1.3 The Seller reserves the right to modify and update the Terms at any time. All amendments take effect from the moment of publication and apply to all orders placed thereafter.

1.4 The Seller has the right to use third parties to fulfill the terms of the contract.

1.5 As a data controller, the Seller ensures that the Buyer’s personal data is processed lawfully, fairly, and transparently in accordance with the General Data Protection Regulation (GDPR), Lithuanian legislation, and the Privacy Policy. Data is processed solely for the purposes of contract execution, invoicing, legal obligations, and customer service.

2. PERSONAL DATA PROCESSING

2.1 The Seller processes the Buyer’s personal data in accordance with GDPR, the Lithuanian Law on Legal Protection of Personal Data, and the Privacy Policy.

2.2 Data is collected only to the extent necessary to fulfill the order, issue invoices, deliver goods, and provide customer service.

2.3 Data is not transferred to third parties except service providers essential to order fulfillment (e.g., couriers, payment processors).

2.4 The Buyer has the right to access, correct, or request deletion of their data at any time by contacting: a.sotvaraite@gmail.com.

3. FORMATION OF THE PURCHASE-SALE CONTRACT

3.1 Orders may be placed and goods purchased by any natural or legal person with legal capacity under applicable law, including: persons of legal age; persons aged 14-18 with parental consent; or persons aged 14-18 using their own funds under Lithuanian law (in this case, parental consent is not required).

3.2 The Buyer selects products from the Online Store and forms an order cart.

3.3 Before confirming the order, the Buyer must ensure that the cart contains only the desired items and that all order data is accurate. The Buyer is fully responsible for the accuracy of the order details.

3.4 The Contract becomes effective when the Buyer pays for the order and the Seller confirms the receipt of the order and payment via email. Payment is considered complete when funds are received in the Seller’s bank account.

3.5 Required data for contract formation and order processing: full name or company name (if the Buyer is a legal entity), activity code and VAT number (if applicable), address of residence or company registration address, delivery address, phone number, and email address. The Seller ensures that this data will be processed in accordance with GDPR and used solely for order fulfillment and communication.

3.6 The Seller undertakes to use the Buyer’s data only for contract execution and not to disclose it to third parties, unless they are responsible for order fulfillment or legally required.

3.7 Contracts are stored in the Seller’s system for the period required by Lithuanian law.

3.8 For orders outside the EU, the Buyer must provide accurate data for customs and shipping. Customs fees, if applicable, are borne by the Buyer. If the Buyer fails to provide necessary data or pay customs charges, the contract is terminated, and the Buyer must cover incurred losses. These costs are deducted from the refund amount.

3.9 The contract is not formed if required data is missing or payment is not made or incomplete. It may also be canceled for other objective reasons as defined in the Terms.

4. BUYER'S RIGHTS AND OBLIGATIONS

4.1 The Buyer has the right to purchase goods in accordance with the Terms provided on the Online Store.

4.2 According to the Government of the Republic of Lithuania Resolution No. 738 of July 22, 2014, clause 10.1.7.12 of the Retail Trade Rules, high-quality jewelry purchased in physical stores is not subject to return or exchange.
Meanwhile, under Article 6.228(10) Part 2 of the Civil Code of the Republic of Lithuania, in online commerce, the Buyer has no right to return high-quality goods that were custom-made or personalized (e.g., engraved, resized, etc.).

4.3 The Buyer must pay for and accept the goods in accordance with the procedures established in these Terms.

4.4 The Buyer agrees to carefully review the product descriptions and photos. By purchasing the product, the Buyer confirms agreement with the product specifications and purchase information provided.

4.5 By placing an order, the Buyer undertakes to provide accurate personal and other information necessary for the order to be fulfilled.

4.6 The Buyer has the right to withdraw from the purchase-sale agreement concluded in the Online Store. In such case, the Buyer must notify the Seller by email at a.sotvaraite@gmail.com within 14 calendar days and return the product via registered mail or courier. The Buyer must clearly state their intention to cancel the contract, return the product, provide their bank account number for a refund, and attach proof of purchase.
Return shipping costs are the responsibility of the Buyer; however, in accordance with Article 6.228(5) Part 6 of the Civil Code, the Seller is also obliged to refund the original delivery cost (if it was applied), unless the Buyer selected a more expensive than standard delivery option.
If the return conditions are met, the Seller undertakes to refund the Buyer within 14 calendar days from the date of receiving the returned product.

4.7 The right stated in Clause 3.6 may only be exercised if the returned item is unused, retains its original commercial appearance, and has no signs of mechanical damage, includes all relevant quality certificates or labels (which must not be damaged or removed), and is returned in its original and neat packaging along with all accessories or gifts, if applicable.
If any of these requirements are violated, the Seller has the right to refuse the return and withhold the payment. In that case, the Buyer has the right to collect the product from the Seller at their own expense.
If the Buyer does not retrieve the item within 30 days, the Seller is no longer obligated to store it.

4.8 Until the returned product reaches the Seller’s specified address, it remains the property and responsibility of the Buyer. The Buyer must ensure secure packaging and keep the tracking number. The Seller is not responsible for loss or damage during return shipping if the item was not properly packaged. The refund will be issued within 14 days of the Seller receiving the product.

4.9 The Buyer does not have the right to return a high-quality item that was specially ordered for the Buyer (not produced or not in stock before the order was placed, and this was stated).

4.10 The Buyer does not have the right to return a high-quality product if it was an individual/custom order or personalized (e.g., engraved, resized, etc., upon the Buyer’s request).

5. SELLER’S RIGHTS AND OBLIGATIONS

5.1 The Seller shall provide the Buyer with access to the services of the Online Store as per these Terms.

5.2 Due to Buyer misconduct or breach of obligations, the Seller reserves the right to restrict or suspend the Buyer's access to the Online Store.

5.3 The Seller may suspend or terminate the Online Store due to technical or other important reasons. However, this does not exempt the Seller from obligations related to already concluded contracts.

5.4 The Seller uses the Buyer's data only in accordance with these Terms.

5.5 In case of contract cancellation, the Seller shall return the money within 14 days.

5.6 If the goods cannot be delivered due to the Seller's fault, a similar item will be offered. If the Buyer refuses the substitute, the Seller shall refund the payment within 14 days.

5.7 The Seller may offer promotions and has the right to control their duration or cancel them without prior notice.

5.8 The Seller is not liable for losses caused by third parties (e.g., banks, couriers).

6. PAYMENT

6.1 Prices are indicated in euros.

6.2 Prices are final; VAT is not applied.

6.3 Delivery charges are not included unless stated otherwise. Delivery costs are calculated during checkout. Buyers outside the EU may be subject to customs fees, which they must pay.

6.4 Payment methods: Stripe (Apple Pay, Google Pay, etc.), Paysera, PayPal, or direct bank transfer.

6.5 The Buyer must pay the full amount within 2 days, unless only a partial advance is allowed.

6.6 For made-to-order goods, the Buyer agrees to pay an advance within 5 days of order confirmation and pay the remainder and shipping within 5 days of notification that the item is ready.

6.7 If payment is not received within 5 days, the order is canceled.

6.8 If the Buyer pays an advance but fails to pay the full amount for a prepared product in time, it is considered a breach of contractual obligations, and the Seller may unilaterally terminate the contract. In such case, the advance is non-refundable. By placing an order and making an advance payment, the Buyer confirms that they have read and understood the Terms and agree that the advance is non-refundable if the contract is terminated due to the Buyer's fault.

6.9 The Buyer agrees to receive purchase documentation upon delivery or collection of goods.

7. DELIVERY CONDITIONS

7.1 Delivery methods: parcel terminals, registered mail, or courier.

7.2 Goods can be delivered in Lithuania, the EU, and other countries.

7.3 The Buyer is responsible for receiving the goods. Delivery to the provided address is considered proper delivery.

7.4 The Buyer must inspect the packaging and contents upon receipt. If damage occurred during transit, they must inform the Seller immediately and provide photos by email.

7.5 If the delivery address is incorrect, the Buyer bears the cost of reshipping.

7.6 The Seller is not responsible for delays caused by the Buyer or external factors.

7.7 Estimated delivery times: Lithuania – 1–2 days processing, 1–3 days shipping; EU – 1–2 days processing, 2–10 days shipping; outside EU – up to 30 days. Preparation begins after full payment.

8. WARRANTY

8.1 All items comply with international and Lithuanian Assay Office quality standards and are certified accordingly.

8.2 Product quality, including gemstone settings, is verified before dispatch. The Seller may photograph the item before shipping.

8.3 The Seller offers free annual jewelry maintenance (cleaning, polishing, checking stone settings). The Buyer covers delivery costs.

8.4 For mechanical damage or wear, the Seller may offer repair at a favorable price.

8.5 The Seller applies the warranty as required by law.

9. PRODUCT DEFECTS

9.1 Upon receiving goods, the Buyer must inspect them. Defects must be reported immediately with supporting photos.

9.2 The Seller may refuse a return if the Buyer fails to notify defects within a reasonable time or does not provide proof.

9.3 Defective items will be repaired. If not possible, they will be replaced or refunded.

9.4 Damage due to misuse is the Buyer's responsibility. The warranty covers manufacturing defects only. Tarnishing due to humidity or improper storage is a natural process and not a defect.

9.5 Color or appearance differences due to screen or lighting settings are not considered defects.

10. COMMUNICATION

10.1 All messages to the Seller must be sent to: a.sotvaraite@gmail.com

10.2 The Buyer receives order information via email and/or phone.

11. FINAL PROVISIONS

11.1 Items, images, and descriptions on the website may not be used for commercial purposes without written consent.

11.2 The Seller may change the Terms without prior notice. Changes take effect upon publication and apply to new orders.

11.3 The Buyer agrees to read and follow the Terms. Breach may result in contract termination and compensation for losses.

12. DISPUTE RESOLUTION

12.1 These Terms are governed by Lithuanian law.

12.2 Disputes shall first be resolved through negotiation. If unsuccessful, complaints may be submitted to the State Consumer Rights Protection Authority or the Lithuanian Assay Office.

12.3 If no agreement is reached, disputes shall be resolved in court based on the Seller’s registered address.

13. GIFT VOUCHERS

13.1 Gift vouchers are valid for 90 days from the purchase date.

13.2 Vouchers can be purchased digitally (sent via email) or physically.

13.3 By purchasing a gift voucher, the Buyer agrees to these Terms.

13.4 Vouchers are not exchangeable, refundable, or extendable. Expired vouchers cannot be used or refunded.

13.5 The Seller may extend the voucher validity in exceptional cases for an additional fee. Requests must be submitted at least 5 days before expiry.

13.6 If the order exceeds the voucher value, the Buyer must pay the difference.

13.7 Vouchers cannot be combined with other offers unless specified by the Seller.

13.8 Vouchers are for single-use only.

13.9 Vouchers can be used by anyone who possesses them.

13.10 If the order is cheaper than the voucher, the unused amount is not refunded.

13.11 Disputes regarding gift vouchers are resolved through negotiation; if unsuccessful, Lithuanian law applies.

13.12 The Seller reserves the right to amend gift voucher Terms.
